This document (General Conditions of Sale) defines the conditions applicable to sales concluded between, on the one hand, persons wishing to make a purchase via the La Botte Gardiane website http://www.labottegardiane.com, hereinafter referred to as " the customer" and on the other hand the company MAG SARL – La Botte Gardiane located ZA Lallemande - RN113, 30670 Aigues-Vives, registered with the RCS of Montpellier under number B 402 115 422, SARL with capital of €7622.00, whose number intra-community VAT is FR55402115422, hereinafter referred to as “La Botte Gardiane”. These conditions apply exclusively to non-commercial individuals.
1. EXCHANGE, RETURN AND REFUND

Return of a standard item:
In accordance with the law, the customer has a period of 30 clear days to exercise his right of withdrawal from the date of receipt of the goods, subject to compliance with the conditions set out in the paragraph below.
Any exchange or return must be the subject of an exchange or return request by email to the address info@labottegardiane.com .
Return costs for an unsuitable item are the responsibility of the customer. Shipping costs for a new product, if applicable, are the responsibility of La Botte Gardiane.
Return of a tailor-made item:
For all our custom-made products (boots, ankle boots and sandals), the right of withdrawal cannot apply, in accordance with the provisions of Article L 222-7 of the Consumer Code as amended by Ordinance No. 2001-741 of August 23, 2001 . Withdrawal is in particular excluded (article 221-28) for contracts for the supply of goods that are clearly personalized or made according to the consumer's specifications, i.e. in particular for tailor-made items, i.e.: all non-standard items and articles with specific additions or modifications (wide foot, strong instep, particular colors, particular soles, etc.).
However, if the fit is not suitable (size, or problem concerning the tailor-made option) an exchange remains possible, within 30 days, in this case please contact customer service by email at info@labottegardiane.com or by telephone at 04 66 73 20 85.
Condition of products:
All returned products (shoes, original packaging, accessories, etc.) must be returned perfectly intact. Upon receipt of the package, La Botte Gardiane will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned products have been visibly used or damaged by the customer and this use or damage renders the products unfit for sale. If the return is refused by La Botte Gardiane, the products will then be returned to the customer at the expense of La Botte Gardiane without the customer being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of their rights. warranty on the goods sold. Subject to compliance with these return conditions, La Botte Gardiane will reimburse products returned within 14 days following the goods being returned to stock, excluding return costs, in accordance with law.
As part of an exchange, the shipping-delivery times mentioned here will apply. If the amount of the customer's exchange order is greater than the amount of their initial order, they will have to pay the difference by credit card or transfer (a special order link will be created and sent to them by email). Shipping of the customer's exchange order is conditional on validation of this payment. If the amount of the customer's exchange order is less than the amount of the initial order, La Botte Gardiane will reimburse the difference.
2. PRICE
All product prices are indicated in euros, all taxes included (outside the EU), shipping costs included for mainland France, Corsica and Monaco. For other destinations, a supplement will be requested, the amount of this supplement varies depending on the destination.
La Botte Gardiane reserves the right to modify its prices at any time without notice. The products will be invoiced on the basis of the prices in force at the time of order registration. The products remain the property of La Botte Gardiane until full collection of the price by La Botte Gardiane. The price is payable in full and in a single payment.
3. ORDER
The customer can order on the internet via the website www.labottegardiane.com or by telephone from Monday to Friday from 8:00 a.m. to 5:30 p.m. at: 04 66 73 20 85.
La Botte Gardiane reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who in its eyes presents any form of risk.
Any order constitutes acceptance of the prices and description of the products available for sale. La Botte Gardiane undertakes to honor orders received on the website only within the limits of available leather stocks and possible restockings. In the absence of availability of one or more product(s) ordered, La Botte Gardiane undertakes to inform the customer as quickly as possible. The customer's order will then be automatically canceled and the corresponding amount refunded.
4. SHIPPING AND DELIVERY
Shipping times vary between 2 working days (if the pair is in stock) and 4 weeks . These deadlines depend on La Botte Gardiane's workload and the speed of restocking of raw materials from its suppliers (leather in particular). The average shipping times observed are 2 weeks from validation of the order. We remind you that all our products are entirely made in France in our workshop, except for leather care products.
- for mainland France, Corsica and Monaco: packages are sent either by Colissimo Suivi or by DPD, with delivery to the selected relay point. Delivery time is guaranteed within 48 hours.
- for Europe and the French Overseas Territories: your package will be sent either via La Poste (Colissimo International/Outre-Mer with proof of delivery) or via DPD. The average delivery time is 8 days (working days).
- outside Europe and for overseas territories: packages are sent via La Poste (Colissimo International with proof of delivery). The average delivery time is 6 to 18 days (working days) depending on the destinations.
Outside mainland France, Corsica and Monaco included, a supplement will be applied for delivery costs. The amount of this supplement will be defined according to the destination.
If paying by check, the order will only be processed upon receipt of the check. Consequently, the deadlines applicable in this case run from the day of receipt of the check.
If the shipping time agreed with the customer is exceeded (minimum 4 weeks after payment), the customer can cancel their order and be refunded, including for personalized orders. La Botte Gardiane undertakes to reimburse the buyer within a maximum of 14 days.
5. PAYMENT

In the event of payment by check, it must be issued by a bank domiciled in mainland France and made payable to La Botte Gardiane. It should be sent to La Botte Gardiane, Customer Service, ZA Lallemande RN113, 30670 Aigues-Vives. Products ordered in stock are reserved for 10 days from the order date. After this period and in the absence of receipt of the corresponding check, the ordered product will then be put back into stock.
Collection is made upon receipt of the check.
Payment is validated upon receipt of the check and upon receipt of additional information requested in the event of payment by credit card requiring additional verifications.

All texts, comments, works, illustrations and images reproduced on La Botte Gardiane are reserved under copyright as well as intellectual property and for the entire world. As such and in accordance with the provisions of the intellectual property code, only use for private use is authorized, subject to different or even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the La Botte Gardiane site is strictly prohibited without prior agreement.
8. GUARANTEES
All Products on sale on the Website benefit from the legal guarantee of conformity (articles L217-1 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), allowing you to return the Products delivered defective or non-compliant.

You have a period of two years from delivery of the Product to act in accordance with the legal guarantee of conformity.

9. RESPONSIBILITY
The company La Botte Gardiane has, for all stages of access to the site, the ordering process, delivery, customer service or subsequent services, only an obligation of means. La Botte Gardiane cannot be held responsible for any inconvenience or damage inherent in the use of the internet network, in particular a breakdown in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.

11. MEDIATION
To comply with the provisions of the Consumer Code regarding the amicable settlement of disputes, La Botte Gardiane will soon inform you of the Mediator Service to which it is attached. After prior written action by consumers vis-à-vis La Botte Gardiane, the Mediator Service may be contacted for any consumer dispute for which the settlement has not been successful.
